class=\"wp-block-list\">\n<li>\u5148\u5929\u8b58\u5225\u6027\uff08inherent distinctiveness\uff09\u2014\u5546\u6a19\u672c\u8eab\u6240\u56fa\u6709\uff0c\u7121\u9808\u7d93\u7531\u4f7f\u7528\u53d6\u5f97\u7684\u8b58\u5225\u80fd\u529b\u3002<br>\u5148\u5929\u8b58\u5225\u6027\u4f9d\u5176\u5f37\u5f31\u53ef\u5206\u70ba\uff1a\n<ul class=\"wp-block-list\">\n<li>1) \u7368\u5275\u6027\u6a19\u8b58\uff08coined mark\uff09\u2014\u975e\u6cbf\u7528\u65e2\u6709\u8a5e\u5f59\u6216\u4e8b\u7269\u4e0d\u5177\u6709\u7279\u5b9a\u65e2\u6709\u542b\u7fa9<\/li>\n\n\n\n<li>2) \u4efb\u610f\u6027\u6a19\u8b58\uff08arbitrary distinctiveness\uff09\uff08\u6216\u7a31\u7b2c\u4e8c\u610f\u7fa9secondary meaning\uff09\u2014\u539f\u4e0d\u5177\u8b58\u5225\u6027\u4e4b\u6a19\u8b58\u4f46\u7d93\u5e02\u5834\u4e0a\u4f7f\u7528\u4f7f\u76f8\u95dc\u6d88\u8cbb\u8005\u8a8d\u8b58\u5176\u5546\u54c1\uff0f\u670d\u52d9\u4f86\u6e90\u4e4b\u6a19\u8b58\u3002<\/li>\n\n\n\n<li>\u4e0d\u5177\u5148\u5929\u8b58\u5225\u6027\u4e4b\u6a19\u8b58\n<ul class=\"wp-block-list\">\n<li>1) \u63cf\u8ff0\u6027\u6a19\u8b58\uff08descriptive mark\uff09\u2014\u5c0d\u5546\u54c1\uff0f\u670d\u52d9\u4e4b\u54c1\u8cea\u3001\u529f\u7528\u6216\u6210\u5206\u3001\u7522\u5730\u7b49\u7279\u6027\u4f5c\u76f4\u63a5\u660e\u986f\u4e4b\u63cf\u8ff0\u7684\u6a19\u8b58\u3002<br>[\u8a3b] \u6697\u793a\u6027\u6a19\u8b58\u8207\u63cf\u8ff0\u6027\u6a19\u8b58\uff0c\u524d\u8005\u5177\u5148\u5929\u8b58\u5225\u6027\uff0c\u5f8c\u8005\u5247\u5426\uff0c\u56e0\u6b64\u5f8c\u8005\u5fc5\u9808\u8b49\u660e\u53d6\u5f97\u5f8c\u5929\u8b58\u5225\u6027\u59cb\u51c6\u8a3b\u518a\u3002\u800c\u4e8c\u8005\u4e4b\u5224\u65b7\u5728\u65bc\u5982\u2014\u5546\u6a19\u7121\u9808\u8b49\u660e\u53d6\u5f97\u5f8c\u5929\u6027\uff0c\u5373\u76f4\u63a5\u51c6\u4e88\u8a3b\u518a\uff0c\u662f\u5426\u5c0d\u7af6\u722d\u540c\u696d\u4e0d\u516c\u5e73\u3002\u800c\u5176\u5224\u65b7\u5247\u53ef\u53c3\u914c\u4e0b\u5217\u56e0\u7d20\uff1a\n<ul \u901a\u7528\u6a19\u7ae0\u6216\u540d\u7a31\uff08generic mark or
